General Terms and Conditions of Sale

INTRODUCTION

These General Terms and Conditions of Sale govern the purchase of products through the website https://luilei.it (hereinafter referred to as the "Site").

Art. 1 Scope of Application

1.1 These General Terms and Conditions of Sale apply to all sales of perfumes, cosmetics, and related products made by the Seller through the Site.

1.2 Entering a tax code (Codice Fiscale) during the purchase process implies that the user is acting as a "Consumer" pursuant to Art. 3, paragraph I, letter a) of the Italian Consumer Code (Legislative Decree n. 206/2005). A Consumer is defined as a natural person acting for purposes unrelated to any entrepreneurial, commercial, professional, or craft activity. Conversely, entering a VAT number (Partita IVA) implies a purchase as a "Professional" pursuant to Art. 3, paragraph I, letter c) of the Consumer Code. The implications regarding warranties and the right of withdrawal differ based on this status, as detailed herein.

1.3 All stated delivery timeframes refer to business days, excluding Saturdays, Sundays, and national holidays. Images, packaging, and descriptions of perfumes and cosmetics on the Site are purely indicative. Product colors and fluid appearance may slightly differ from actual items due to the visual settings of the devices used for viewing.

1.4 These General Terms and Conditions may be modified at any time. Any updates will be effective immediately upon publication on the Site. Users must review the most updated version before making any purchase. The applicable terms are those in force on the date the purchase order is officially submitted.

1.5 Under no circumstances shall the Seller be held liable to the user or third parties for indirect, incidental, special, or consequential damages (including loss of income). The Seller does not guarantee the absolute accuracy or completeness of information provided by third-party brands on the Site.

Art. 2 Purchases on the Site

2.1 To make a purchase, the user must follow the online checkout procedure. The sale contract is considered concluded when the digital order form reaches the Seller's server and payment authorization is confirmed.

2.2 You guarantee that all personal and shipping information provided is complete, true, and accurate. You agree to hold the Seller harmless from any damage, delivery failure, or penalty arising from a breach of this commitment or typing errors.

2.3 Following a successful purchase, you will receive an automated order confirmation email containing the Seller's data, the core product characteristics, the final purchase price (including taxes), the chosen payment method, the specific shipping address, and information regarding the right of withdrawal.

Art. 3 Product Availability

3.1 Perfumes and cosmetics are offered in limited batches. Due to simultaneous access by multiple users, a product may become unavailable immediately after order submission.

3.2 If a product becomes unavailable after purchase, the Seller will inform you immediately via email. You will be entitled to terminate the contract and receive a full refund within a maximum of 10 business days. Alternatively, the Seller may offer a delivery extension or a replacement product of equivalent value, subject to your explicit approval.

Art. 4 Prices and Shipping Fees

4.1 All prices displayed on the Site include Italian VAT. Prices are updated dynamically and the Seller reserves the right to change them without notice. The price charged will be the one displayed at the exact time the order is submitted.

4.2 Shipping is not free. Shipping costs are explicitly calculated and displayed to the customer during the checkout process before the order is finalized.

4.3 Product ownership transfers upon shipment (when delivered to the carrier). However, the risk of loss or damage transfers to the user only when the user (or a designated third party) takes physical possession of the products.

4.4 Prices are not personalized based on automated decision-making or profiling algorithms (in compliance with Legislative Decree No. 26/2023). During promotional price reductions, the Site indicates the lowest price applied to that specific product within the previous 30 days.

Art. 5 Payment Methods

5.1 All payments are encrypted and processed through secure third-party gateways. In compliance with PSD2 (Directive 2015/2366/EU), Strong Customer Authentication (SCA) may be requested. The Seller never accesses or stores your full credit/debit card data.

5.2 Accepted payment methods include: Visa, MasterCard, American Express, Maestro, Google Pay, Apple Pay, and any other secure methods displayed at checkout. Cash on delivery (Contrassegno) is not accepted unless explicitly stated on the checkout page.

Art. 6 Delivery

6.1 Delivery is available within Europe. Estimated delivery time is typically 5 to 8 business days, unless a temporary delay occurs. The Seller reserves the right legally to fulfill any delivery within a maximum window of 30 days from order confirmation.

6.2 Upon delivery, the customer must check the physical integrity of the parcel. If the packaging is damaged, wet, or visibly tampered with, you must accept it "with reserve" (accettazione con riserva) written clearly on the courier's receipt and notify our customer service at info@luilei.it immediately.

Art. 7 Right of Withdrawal (Returns and Refunds)

7.1 This article applies only to Consumers. It does not apply to Professionals purchasing with a VAT number.

7.2 Pursuant to Article 52 et seq. of the Consumer Code, the Consumer has a period of 15 calendar days to withdraw from the contract without giving any reason, starting from the day the product is physically delivered.

7.3 Legal Exceptions (Hygiene and Health Protection): Pursuant to Art. 59, letter e) of the Italian Consumer Code, the right of withdrawal is strictly excluded for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.

Therefore, perfumes, creams, lotions, cosmetics, and makeup items whose outer protective packaging, box seals, or cellophane wrap have been opened, broken, or tampered with after delivery are completely ineligible for a return or refund.

7.4 Return Process & Costs: To initiate an authorized return for an eligible, fully sealed item, contact info@luilei.it.

• The customer is solely responsible for paying the direct shipping costs for returning the item. Original shipping fees paid at checkout are non-refundable.

• Items must be sent using a trackable courier to the following address:

7.5 Refunds: If the returned product is inspected and approved as completely intact, sealed, and unused, the Seller will issue a refund of the product price within 10 business days, using the same payment method used for the initial transaction.

Art. 8 Legal Warranty of Conformity

8.1 For Consumers, the Seller provides a 2-year Legal Warranty from the date of product delivery for any lack of conformity (e.g., defective spray nozzles, broken bottles upon arrival, or expired cosmetic formulas). Any defect must be reported immediately to info@luilei.it.

8.2 The Consumer is entitled to a free product replacement, a proportional price reduction, or contract termination with a full refund, depending on the severity of the damage, as per Art. 135-bis of the Consumer Code.

8.3 For Professionals, the legal warranty is governed strictly by the Italian Civil Code (Art. 1490 et seq.); any defects must be reported within 8 days of discovery, and the warranty expires exactly 1 year after delivery.

Art. 9 Governing Law and Jurisdiction

10.1 These General Terms and Conditions of Sale are governed by Italian Law, specifically the Italian Consumer Code (where applicable) and Legislative Decree No. 70/2003 on Electronic Commerce.

10.2 Jurisdiction: For disputes involving a Consumer, the competent court is mandatory by law to be the place of residence or domicile of the Consumer. For disputes involving a Professional, the exclusive competent court shall be the Court of Potenza, Italy.

10.3 Alternative Dispute Resolution (ADR): Consumers may access the European Commission’s Online Dispute Resolution (ODR) platform for out-of-court dispute resolution at: https://ec.europa.eu/consumers/odr/.

Art. 10 Customer Service & Reviews

11.1 For any assistance, requests, or complaints, you can contact our customer support at info@luilei.it. Our typical response timeframe is 2 business days.

11.2 Reviews: In accordance with Legislative Decree No. 26/2023, the Site may display user reviews. The Seller clearly states whether reviews are verified from actual purchasers or if any promotional or sponsored relationships (e.g., influencers) exist regarding the product reviews.
